A new class action lawsuit alleges that Walmart and Target violated Florida law by charging customers in the Sunshine State sales tax on American flag purchases.
Plaintiff Pamela Knopman alleges that Walmart and Target are violating state laws that prohibit retailers from collecting sales tax on American flag sales.
Knopman also argues that collecting taxes on the sale of American flag kits, which include accessories such as mounting brackets, standards, halyards and on-label instructions, violates Florida law.
“Defendants, as licensed retailers, knew or should have known that the sale of the American flag in Florida was tax-exempt and sales tax exempt,” Stars and Stripes Class Action Lawsuit states.
Knopman hopes to represent a national class of consumers who purchased the Star Spangled Banner online at Target or Walmart in Florida and were charged an amount that appears as sales tax or a fee within the past four years.
