The Arkansas Department of Energy and Environment Division of Environmental Quality (“DEQ”) has distributed the following advisory:
RCRAInfo’s 2023 Biennial Report module is now live and data collection has begun.
DEQ also states:
- Facilities may begin entering data for the 2023 Biennial Hazardous Waste Report. However, submissions will not be allowed until after January 1, 2024. He has until March 1, 2024 to submit this report.
The Resource Conservation and Recovery Act (“RCRA”) is a federal environmental law that creates a framework for the proper management of hazardous and non-hazardous solid waste. Subtitle C of the RCRA addresses the management of hazardous waste from cradle (i.e., generation through transportation) to grave (disposal).
Arkansas received a mandate for the federal RCRA program in the mid-1980s. As a result, we implement our programs in accordance with Arkansas Pollution Prevention and Ecology Code 23.
The reports referred to by DEQ are those that must be submitted describing the nature, quantity, and disposition of hazardous waste generated at a facility.
The DEQ reminder outlines who must report:
- A facility that was a fully regulated large capacity generator (LQG) or small quantity generator (SQG) during any month.
- A facility that processes, stores, or disposes of RCRA hazardous waste on-site within a waste management unit that is subject to RCRA permitting requirements.
- Facilities registered with DEQ as LQG or SQG.
