Skuld Club’s local correspondent Omur Marine informs us about the latest pollution rates, which are in force from January 1, 2024 under the Turkish Environmental Law.
aAccording to Omur Marine, it is important to note that the scale of applicable marine pollution fines is updated annually. According to the proposed amendment published in the Official Gazette on November 25, 2023, the rate of increase in marine pollution fines in 2024 is regulated at 58.46%. As a result, as of January 1, 2024, fines will be imposed under Article 20 of the Environmental Law at the following rates:
#1 For pollution caused by tankers discharging petroleum and petroleum derivatives (crude oil, fuel products, bilge, sludge, slop, refined products, oil and fat waste, etc.):
i) For vessels below 3.184,81 TL per 1000 GT / GT.
ii) For vessels between 1000 GT and 5000 GT / 796,23 TL per GT in addition to the above fines.
iii) For vessels over 5000 GT, 79,59 TL per GT in addition to the above fine.
#2 For pollution caused by tankers discharging dirty ballast:
i) 580,25 TL per GT for ships less than 1000 GT;
ii) For vessels between 1000 GT and 5000 GT, in addition to the above fine of 115.76 TL per GT.
iii) For vessels over 5000 GT, 18,37 TL per GT in addition to the above fine.
#3 For pollution caused by ships and other naval vessels discharging petroleum derivatives (bilge, sludge, slop, fuel products, oily waste, etc.) or dirty ballast:
i) 1.592,40 TL per GT for vessels less than 1000 GT.
ii) For vessels between 1000 GT and 5000 GT / 318,49 TL per GT in addition to the above fines.
iii) For vessels over 5000 GT, 79,59 TL per GT in addition to the above fine.
#4 For pollution caused by tankers, ships and other naval vessels discharging solid waste and domestic wastewater:
i) For vessels below 796.23 TL per 1000 GT/GT.
ii) For vessels between 1000 GT and 5000 GT, in addition to the above fine of 159.25 TL per GT.
iii) For vessels over 5000 GT, 18.37 TL will be added to the above nominal amount per GT.
