Dallas, Texas (October 16, 2023) – On September 27, 2023, the U.S. Environmental Protection Agency (EPA) entered into a Consent Agreement and Final Order (CAFO) with Evergreen Packaging LLC (“Evergreen”) for alleged violations of the Clean Air Act (CAA). Did. The CAFO alleges that Evergreen failed to control hazardous air pollutants (HAPs) within its facilities. Pursuant to the settlement, Evergreen must take several corrective actions at its facilities to maintain compliance with the CAA. Evergreen maintains a repair and replacement program for digester capping valves and employs independent inspectors to conduct inspections of all parts of the bleach plant and bleach equipment for any problems found with hood openings or enclosures. A report identifying each incident must be prepared and submitted to EPA. Must be open and must submit compliance status update notifications.
Additionally, Evergreen has agreed to undertake a $2.1 million Supplemental Environmental Project (SEP) to reduce HAPs in its wastewater treatment system. Evergreen will install 10 new mechanical aerators in the wastewater treatment system and relocate the outfall locations. By adding an aerator and relocating the drain, Evergreen is able to provide more accurate and reliable flow monitoring, reducing the total amount of suspended solids at the drain and directing the wastewater flow.
