CHESAPEAKE (WABY) – The November 22, 2022, shooting at The Greenbrier has led to several lawsuits against Walmart. Six people died. One lawsuit has been put on hold for the time being, but four others remain ongoing, some for as much as $50 million.
Four ongoing lawsuits involve plaintiffs who were employees at the time and survived the incidents. Donya Prioleauwho filed within a week of the shooting. Sarah Merlowas shot seven times but survived. james kellyBrianna Tyler. An additional lawsuit was filed by Teresa Blevins on behalf of her husband, Randy, who was killed that night. Blevins closed his case earlier this year with the option of re-litigating at a later date.
Two weeks ago in Chesapeake Circuit Court. Walmart had a lawyer, and so did Tyler.. Less than seven weeks after she started working at Battlefield’s Boulevard store, her shift supervisor started shooting.
Walmart said it can’t sue because it’s a workers’ compensation case. But Judge Steven Terfeyan ruled this week that Mr. Tyler’s case can proceed.
He said Walmart should be held responsible for the actions of the employee who fired the shot and that Tyler’s argument that the company should have seen red flags that he was a danger to others is realistic. Ta. Walmart can appeal. Telfeyan rejected Tyler’s claims of either gross negligence or willful wanton negligence.
Tyler was not injured, but the bullet penetrated the hood of her jacket as the gunman chased her and fired before she could escape. As with the other three lawsuits, Tyler alleges damages for bodily injuries, extreme pain and suffering, numerous emotional and psychological consequences, as well as lost wages and medical expenses.
If Walmart wins some or all of its workers’ compensation claims, lawyers told 10 On Your Side that Virginia has one of the strictest workers’ compensation laws in the nation.
The Virginia Code states: What is the value of losing various parts and functions of the body? Whether the injury was caused by a workplace injury and its details. What can dependents recover if a loved one dies at work?
For example, if a full-time worker making $15.50 an hour dies on the job, the victim’s dependents could be entitled to recover up to about $207,000.
